AAAphotos Terms and Conditions -
  1. General Terms
    1. In these terms and Conditions (“the Conditions”);

      “Delivery Address”       means the address for delivery of the Goods to You, as indicated by You when placing an Order;

      “Goods”       means any Goods (including all components, parts and accessories) to be supplied by Us to You under these Conditions;

      “Order”       means the placing of an Order (or an Order via the Website)

      “Our/Us/We”       means AAAphotos Ltd, a company registered in England and Wales under company no. …………
      “Website” means Our website of www.AAAphotos.co.uk

      “You / Your” means the person who purchases the Goods from Us

    2. The supply of Goods to You and Your use of the Website is subject to these Conditions including Our Privacy Policy and the Website terms and Conditions of use.  Please read through these Conditions carefully before placing an Order and print a copy for Your future reference.  The placing of an Order with Us shall be deemed to be Your acceptance of these Conditions. 
    3. No variation of these Conditions shall apply unless confirmed in writing by or on behalf of a Director of AAAphotos Ltd.  We reserve the right to amend and update these Conditions and this website at any time without notice and it is Your responsibility to re-visit this page each time You use the website or place and Order with Us to ensure that You comply with the Conditions.
    4. By submitting an Order, or using the Website You shall be deemed to have accepted these Conditions.
    5. These Conditions together with Your Order form complied through the checkout process constitute the while agreement between the parties and superseded any prior promises, representations, undertakings or implications whether written or oral.
    6. All images and prints displayed are offered solely as an invitation to treat and are sold as seen.
    7. We request that You note the right of cancellation in clause 2. and the limitation of liability in clause 14.
  2. Acceptance
    1. All Goods are subject to availability.  If the Goods You have ordered are unavailable We will contact You to advise of the date of availability or to discuss the supply of suitable alternative item.  Should You wish to cancel Your Order at this point then You will be able to do so.  If the Goods ordered are available, We will then send You written confirmation of acceptance of the Order.
    2. You will be responsible for ensuring that the Order is complete and accurate including all spelling and grammar.  You acknowledge and accept that We will not be held responsible should this not be the case.
    3. You must be over the age of 18 years to place and Order and We reserve the right not to accept an Order where We reasonably believe that You do not meet this requirement. 
  3. Cancellation
    1. Under the distance selling regulations You have the right to cancel Your Order with Us at any time up to seven working days starting on the day after delivery.  Your Order will not be considered cancelled until written notification is received from You.  This must be sent to support@aaaphotos.co.uk .  You shall be entitled to a full refund (excluding postage and packaging) within 30 days of receipt by Us of such notice.
    2. Please keep evidence of the cancellation safely with Your Order details. 
    3. We shall not be bound to accept the cancellation, alteration or suspension for whatever cause of any Order so confirmed and the agreement by Us to any such cancellation, alteration or suspension shall be subject to You indemnifying Us in full in respect of all and any expense and loss incurred or sustained by Us as a result.
    4. Goods returned for any reason must be turned within 14 days from the date of delivery of them, and in the same condition as they were delivered (with the original packaging, unused).  Unless the Goods are faulty, You must pay any delivery costs for their return.  We will not accept return or cancellations if the Goods have been altered in any way that could be deemed as You treating the Goods as Your own.  Please note that You have a duty to take reasonable care of the Goods whilst they are in Your possession.
    5. If the Goods You are returning are either damaged by You due to Your poor packaging then on inspection of the Goods We reserve the right to reject the return and You will incur the cost of redelivery to Your address and no refund will be processed.
    6. All bespoke items (where You have specified certain colours, additional branding, or any other type of variation which do not come as standard) are non-refundable.
    7. A refund will only be credited back to the credit card holder’s account which was used to make the original purchase.
  4. Description
    1. For the avoidance of doubt all sizes, measurements, drawings, descriptive matter, specifications, illustrations, photographs and advertising issued by Us on the website are an approximation and are published for the sole purpose of giving an approximate idea of the Goods described.
  5. Quality
    1. We warrant that subject to these Conditions upon delivery and for a period of 12 months from the date of delivery the Goods will be:
    2. Of satisfactory quality within the meaning of the Sale of Goods Act 1979;
    3. Reasonably fit for the purpose for which the Goods are being sold by Us;
    4. Reasonably fit for the purpose for which the Goods are being bought if You had made known that purpose to Us in writing and We have confirmed acceptance of the purpose in writing.
    5. We shall not be liable for a breach of the warranties where;
    6. You make any further use of the Goods after giving notice
    7. The defect arises because You failed to follow Our oral or written instructions as to the storage, installation, use of, or maintenance of the Goods; or
    8. You alter or repair the Goods without Our written consent
    9. Images are sold as seen and You accept that image quality may vary and may suffer from some blurring and distortion.
  6. Price and Payment
    1. Unless otherwise agreed, the price of the Goods shall be the price confirmed in the acceptance notice.
    2. Placing an item in Your cart doesn’t reserve the price shown at that time.  It is possible that an items price may increase or decrease between the time You place it in Your cart and the time You purchase it. 
    3. With respect to items sold by AAAphotos, We can’t confirm the price of an item until You Order; however, We do not charge Your credit card until after Your Order has entered the shipping process. 
    4. Despite Our best efforts, a small number of the items in Our shop may be mispriced.  If an items correct price is higher than Our stated price, We will, at Our discretion, either contact You for instructions before shipping or cancel Your Order and notify You of such a cancellation.
    5. All prices, fees, charges, disbursements, expenses and other sums payable hereunder are in pounds sterling (£) and are inclusive of Value Added Tax.
    6. The cost of postage and packaging per item can be found during the check-out process on Our Website.  Please note that the postage and packaging is mainly dependent on the size, weight and frailty of the Goods. 
  7. Payment
    1. Payment is taken by credit or debit cards and is processed once You have received and acceptance notice from Us.  We accept MasterCard and Visa. 
    2. Payment details will be taken at the point of Order and will be processed once We have accepted Your Order.  Payment will be processed via Google Checkout secure payment system.
    3. You undertake that all details You provide to Us for the purpose of purchasing any Goods are correct, and that the credit or debit card which You use is Your own, that there are sufficient funds or credit facilities to cover the cost of any Goods, and that You are over the age of 18 years.  We reserve the right to obtain validation and verification of the authenticity of Your credit or debit card details before processing You Order.
    4. Some discounts are limited-time offers.  The discount We are able to offer for any item is dependent upon its availability. 
  8. Delivery
    1. The Goods shall be delivered to the delivery address as set out in the Order, or to such other place of delivery as is agreed by Us in writing prior to the delivery of the Goods.
    2. Times for delivery of Goods from the date of acceptance of Your Order may vary and are intended to be an estimate only.
    3. You acknowledge and accept that We will not be responsible for any mistakes made during the checkout process by You regarding incorrect product ordered, contacts, and address or delivery details. 
    4. Where an error has been made You will be solely responsible for notifying Us in writing of the correct details before the Goods have been dispatched or as soon as possible thereafter.
    5. All Goods are available for delivery in most places in mainland UK.
    6. If You have any specific delivery requirements then please contact Us at support@aaasports.co.uk in advance of placing an Order.
  9. Combining Shipments
    1. When possible, We try to combine multiple orders into the same shipment.  This helps Us to reduce the number of packages We need to send to You, so You receive fewer packages and have less packaging material to dispose of when You receive Your orders. 
    2. We try to combine multiple orders into the same shipment if the orders meet the following criteria:
      1. Multiple orders are placed to the same customer
      2. Multiple orders are being shipped to the same address
      3. The orders are shipping  at around the same time
  10. Non-Delivery
    1. We shall not be liable for any non-delivery of the Goods unless written notice is given to Us within 7 days of the date when the Goods would in the ordinary course of events have been received.
    2. Our liability (if any) for non-delivery of the gods shall be limited to replacing the Goods within a reasonable time of issuing a credit note for the value of the price paid for such Goods.
  11. Exchanges
    1. If You would like to exchange an item for a different variation – e.g. size, colour please contact Us at support@aaaphotos.co.uk for this to be arranged. 
    2. The original item must be returned to Us in an unused and resalable condition, with all original undamaged packaging.  After We confirm Your returned item meets the eligibility criteria We will dispatch Your new item for delivery. 
    3. If your new item is higher in price than the item you are returning the difference must be paid prior to your exchange item being dispatched.
    4. You will be responsible for all postage and packaging costs associated with the return of Your original item and the delivery of Your exchange item. 
    5. If We deem Your returned item not to meet the Conditions stated for returns We will return the item to You and You will be responsible for the costs associated with this return. 
  12. Damaged Items
    1. If You receive an item that was damaged, please contact Us via email at support@aaaphotos.co.uk and inform Us of the damage as soon as possible. 
    2. If You are returning a product which is faulty, a refund of the delivery charge will also be made. 
    3. A refund of delivery charges will only be made when a product is found to be faulty, damaged or incorrect.
  13. Wrong Items
    1. If You receive a wrong item, please contact Us via email at support@aaaphotos.co.uk
  14. Items that can’t be returned
    1. AAAsports does not accept returns for the following items:
      1. Downloadable products including digital photographs emailed to You
      2. Items made to Order including photograph prints
  15. Limitation of Liability
    1. Nothing in these Conditions excludes or limits Our liability for death or personal injury caused by Our negligence or fraudulent misrepresentation
    2. Our total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance of the contract shall be limited to the contract price.
    3. You agree to indemnify Us and hold Us and Our subsidiaries, affiliates, directors and employees harmless from any claims, costs, expenses, liabilities, losses, proceeding or demands (including all reasonable professional fees) made by any third party to or arising out of Your breach of any of these Conditions or Your violation of any law or right of a third party.
  16. Force Majeure
    1. We reserve the right to defer the date of delivery or to cancel the contract or reduce the volume of the Goods ordered by You (without liability to You) if We are prevented from or delayed in the carrying on of Our business due to circumstances outside Our reasonable control including, without limitation, strike, lock-out or other industrial action, terrorist activity, civil commotion, government action, acts of god, war or national emergency or other continuous period in excess of three months then You shall be entitled to give notice in writing to terminate these Conditions and a full refund will be made
  17. Miscellaneous
    1. The headings to these Conditions are for convenience only and shall not affect their construction
    2. Where the context so admits reference in these Conditions to one gender shall include each other gender and words denoting the singular shall include the plural and vice-versa
    3. References to any statutes or statutory provision shall, unless the contract otherwise requires, be construed as a reference to that statute or provision as from time to time amended, consolidated, modified, extended, re-enacted or replaced
    4. A person who is not party to these Conditions has no right under the contracts (Right of Third Parties) Act 1999 to enforce any term of these Conditions
    5. Any copyright, trademarks or other intellectual property rights contained on the website and in all particulars, brochures or other material prepared by Us shall belong to Us unless otherwise stated
    6. The parties irrevocably agree that the courts of England have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Conditions.
    7. If any portions of these Conditions are held by any competent authority to be unenforceable in whole or in part, the validity or enforceability of the other sections of these Conditions shall not be affected.
  18. Data Protection
    1. You warrant that the details and information provided to Us are true and correct and that any future additions or alterations to Your details and information will be true and correct, and submitted in a timely manner.  We will not be liable to You for any reason arising from any instructions or Order supplied by You which is incomplete, incorrect, inaccurate, illegible, out of sequence or in the wrong form or arising from their late arrival or other fault of Yours.
    2. It is Our policy to respect the privacy of Our customer.  We will not disclose the details and information provided by You to any third party unless We are specifically required to do so by law, or in response to a valid, legal request by a law enforcement or governmental authority or as may otherwise be authorised by You.
    3. By accepting theses condition, You acknowledge and consent that We may store and process Your personal details and information (for example Your name, address, telephone number and details of the service You use) in accordance with any data protection legislation and that We may use this information for marketing purposes.  We have a responsibility to keep Your information confidential and will only use it to offer Our products and services
  19. Statutory Rights
    1. Your statutory rights are not affected by any part of these terms and Conditions
